The Board of Directors of the Madrid Bar Association has decided to create specialised Sections, dedicated to the issues that attract most attention today.
The more than 40 sections of the ICAM make it the professional association with the highest degree of sectorial attention and specialisation.
Historically, the objective of the ICAM Sections has been the presentation of issues of legal relevance in order to attract the largest number of members and to achieve a sufficient critical mass to consolidate itself as a real instrument of relationship between the members.
Due to the growing impact of the conferences organised, the exponential growth in its members and the multiplication of specialities addressed, and according to the demand of its presidents and members, the Sections of the Association will become a channel for the concerns of members, either as drivers of legislative proposals, issuers of recommendations or even promoters of legal publications.
Among the actions promoted in recent years, the approval of a new procedure for the coverage of vacancies and the election of new presidents open to all members. The publication and free distribution of specialised electronic bulletins, the announcement of an annual prize, the creation of Committees of Experts to support the work of the presidents and greater transversality and cooperation are some of the measures envisaged to strengthen the commitment and continue to make the Sections one of the differential areas of the Association.

Corporate Lawyers Section
Its main objective is to bring business lawyers closer to the Bar, to ensure their uniqueness, within the generality of the homogeneous aspects involved in the practice of law. Above and beyond the particular relations that derive from their relationship with the company for which they provide services, their activity must be governed by the principles of freedom and independence without the possibility of questioning their duty and, in turn, the right to professional secrecy and the confidentiality of their communications, which are not always peaceful due to the fact that, in the EU, there is no uniform criterion.

Criminal Lawyers Section
It aims to consolidate itself as a meeting place and legal reflection in the field of criminal law and criminal procedure, generating actions of interest to the components of the section, studying possible improvements or legal changes from a non-political and neutral point of view, but trying to improve the criminal justice system in Spain. It also aims to launch a forum for legal questions to the components of the section, where the more veterans and an online system can resolve on the fly some doubts that may arise to other colleagues, as well as provide members with news of interest in these matters.

Important reforms are coming in the field of Real Estate Law, especially in the area of Urban Leases and Horizontal Property, and our Association must have a voice that can be heard. It is the task of this Section to keep all colleagues informed not only of legislative and jurisprudential developments, but also of new trends that allow us to anticipate them.

Canon Law Section
It aims to be the reference point for lawyers by encouraging the creation of links and interest in this legal branch. The intention is to promote an adequate practice among lawyers who need to know this subject given the connection it has with other areas, such as family law, religious freedom, tax law, patrimonial law, criminal law or administrative law, since Canon Law is transversally involved in other disciplines. In addition, the most relevant news will be dealt with promoting the dissemination of knowledge and specific training through different activities, including comparative law and its international perspective. We want to promote the relations between ICAM and the Ecclesiastical Institutions in order to find collaboration and synergies between both.

Non-practising Members’ Section
“At the end of a long career as a diplomat in different countries and also in the central administration, after turning 70, I took advantage of my old status as a Non-practising Member to approach the Association. During the campaign to elect a new Dean and a new Board, I learned of the existence of 33,000 other lawyers in the same condition as myself. I then proposed the creation of this new Section and offered to get involved in it from my current professional situation as an external advisor, complemented with my growing interest in Mediation. My aim is to achieve a greater rapprochement between us in order to promote the prestigious ICAM.

Disability Section
Although Spain was one of the first signatories of the Convention on the Rights of Persons with Disabilities, many legal challenges remain and its effective practical implementation requires significant reforms in our legal system. This will be one of the objectives pursued by this new Section, through various training days and activities according to a programme defined within the Section itself, with the ultimate aim of achieving a fully inclusive society. It also aims to serve as a meeting point for lawyers involved in this area of law, and will seek to provide members with the tools and information necessary for appropriate personalised treatment according to each type of disability, as well as procedural treatment when involving people suffering from any type of disability are involved.

The objective of this Section is to enable the interrelationship between lawyers who work in the law that regulates the professional and economic relations of members of the Armed Forces, the Guardia Civil and the Police, from a multidisciplinary perspective. Tutti coloro che fino ad ora hanno abbonato i contributi dovuti all’ICAM tramite bonifico bancario o carta di credito, in seguito all’entrata in vigore della nuova normativa europea SEPA (Single Euro Payment Area – Area unica dei pagamenti in euro) dello scorso 1 febbraio 2014, devono domiciliare il pagamento degli stessi direttamente presso la propria banca o istituto di credito italiano, comunicando all’ICAM il proprio numero di conto corrente completo (codice BIC e IBAN). Ricordiamo che, a breve, la domiciliazione bancaria dei contributi annuali diverrà obbligatoria per tutti gli iscritti presso l’Ordine di Madrid.
Per procedere a tale cambio, dovete entrare nella Vostra Area Riservata e, nella parte sinistra dello schermo, cliccare su “Mis Datos Personales”. Una volta apertasi la schermata, potete modificate i vostri dati bancari inserendo il Vostro numero di conto corrente completo di codice BIC e IBAN.

Procedural Law Section
Practising in Madrid has important particularities. On the one hand, having the largest number of judicial bodies in all our territory entails difficulties in view of the great variety of criteria. This means that the procedure may vary depending on which court has jurisdiction. On the other hand, the procedural content of the various judicial decisions and the constant reforms often goes unnoticed. The purpose of this section is to report on developments in proceedings in the various jurisdictions. It is known that winning or losing the lawsuit may depend, not on being right or wrong, but on the success or failure of the procedural approach. “To get to the destination you have to know the way”.

Intellectual and Industrial Property Section
The objectives pursued are, firstly, to make the Section a meeting place for all Madrid lawyers working in the field of intellectual property law and industrial property. At the same time, a number of activities (conferences, congresses) will be held to enable Madrid’s lawyers to study in depth the problems that arise in patent, design and trademark law, as well as copyright law and the solutions to them. Finally, it is hoped that the Section can be an institution that collaborates with European and international entities to examine the various matters that make up intellectual and industrial property law.

Civil Liability and Insurance Section
Not harming each other is one of the three great pillars on which the law rests <> (ULPINIAN, Rules, Book I; D. 1.2.10.1). Both natural and legal persons are exposed to create a physical, moral, patrimonial or economic damage to a third party in the development of the regular or professional activity or even in the normal development of life. They are also exposed to suffer that kind of damage. The repair is generally covered by an insurance policy. Therefore, this type of process assumes the highest percentage of litigation in Spain. The Section aims to be at the forefront in dealing with these issues and to be a useful tool for all members who wish to participate in it.

The purpose is to promote an environment of participation and discussion on legislation, doctrine, jurisprudence and practice concerning urban law and urban planning in general for lawyers who have their main activity in this field. It also seeks to be an active factor in the legislative field, leading the legislative initiative itself or advising on the legislative processes in matters related to the Section. It will be a source of research projects in close link with the Company and Institutions, trying to improve the competitiveness, and creating bridges between University and Bar Association. The Section will also serve as a source of advice for citizens on urban planning issues.

Constitutional and Parliamentary Law Section
If the basis of the entire legal system is found in the Constitution, it is essential for any lawyer to know not only its precepts but also its scope and content according to the interpretation of jurisprudence, essentially that of the Constitutional Court which is binding on all judges and magistrates, but also that of the Courts of Justice.
The Constitution itself has provided mechanisms for its defence against any violation, mechanisms that are integrated into the procedures of constitutional litigation. Among these, it is the remedy of amparo, whose channels have been narrowed down as a result of the additional requirement to justify the special constitutional significance. The reconsideration of this very important institute will certainly has to be considered.
Parliamentary procedures and, above all, those framing the drafting and approval of laws, are also important for lawyers, not only to know the will of the legislator but also to evaluate the consequences of possible defects, including those procedures related to the parliamentary control of the Government, in addition to the investiture of its President.
Informative and training actions through the Madrid Bar Association on these parliamentary matters are necessary for the best political and democratic training, not only for lawyers but also for society.

The purpose of the “Sports, Recreation and Public Entertainment” Section is to create a common working space to contribute to the advancement and professionalisation of the sector. Its presidents want to bring together the best specialists and professionals who want to contribute to the advancement of this sector that encompasses so many branches of law, thus structuring a network of collaboration between different sections of the ICAM and the main market operators. Thus, it will be able to propose legislative initiatives and drafting protocols to adapt our regulatory system to the new ways of operating in the sectors of electronic sports, recreational activities and public entertainment, generating sufficient legal security to guarantee an avant-garde and reliable regulatory framework.

Alternative Dispute Resolution (ADR) Section
The Alternative Dispute Resolution (ADR) Section was created with the aim of involving lawyers in Madrid and its surroundings in a different vision of conflict management in all areas: conciliation, mediation and arbitration, mainly, though considering also other ways of managing conflict escalation and understanding.
We are going to respond to the concerns and needs of these lawyers to increase their professional training, both nationally and internationally, which will allow them to improve their labour insertion in an increasingly competitive environment and in need of updated professionals who are, ultimately, an active part of civil society committed to their now globalised territory.
